Bandemer, n20 the Supreme Court reviewed a decision of a district court holding that the 1981 reapportionment of the Indiana General Assembly unconstitutionally diluted the votes of Democrats. The lower court had based its decision in part on the fact that about 52 percent of votes cast statewide in races for the state House of Representatives were cast for Democrats, yet Democrats won only 43 of 100 seats. n21 The Democrats had alleged that this was achieved through the use of "stacking" Democratic voters into districts with large Democratic majorities, thus "wasting" their votes, and "splitting" them in other districts so as to give Republicans safe districts where Democratic votes are ineffectual. n22 The defendants had appealed contending, first, that a claim of political gerrymandering was not justiciable under Baker v. Carr n23 and second, that if it was, the Democrats' rights had not been violated."
